Tazuz End User License Agreement (EULA)
Agreement
Tazuz (called Ryck in Sweden, internal name Leeway; the "Licensed Application") is licensed to you (the "End-User") by Karol Billik, established in Slovakia (the "Licensor"), for use only under the terms of this License Agreement.
By downloading the Licensed Application from Apple's App Store, and any update to it that this agreement permits, you agree to be bound by all the terms of this License Agreement. The App Store is referred to here as the "Services".
You and the Licensor acknowledge that this License Agreement is between you and the Licensor only, and not with Apple. The Services are not a party to it and are not bound by any provision about the Licensed Application, such as warranty, liability, maintenance or support. The Licensor, not Apple, is solely responsible for the Licensed Application and its content.
This License Agreement does not give usage rules that conflict with the latest Apple Media Services Terms and Conditions (the "Usage Rules"); the Licensor has had the opportunity to review them. The Licensor reserves all rights not expressly granted to you. The Licensed Application is for Apple devices running iOS. The Terms of Use and the Privacy Policy also apply to your use; if they conflict with this agreement about the license itself, this agreement prevails.
1. The application
Tazuz is software for iPhone that keeps distracting apps locked, using Apple's Screen Time, until you earn minutes with push-ups that the iPhone camera counts on the device. It also offers paid features through auto-renewing subscriptions, handled by Apple (see the Terms of Use).
2. Scope of license
- 2.1 You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Apple-branded device that you own or control and as permitted by the Usage Rules, except that the Licensed Application may also be used by other accounts associated with you through Family Sharing or volume purchasing.
- 2.2 This license also covers updates of the Licensed Application that the Licensor provides and that replace, repair or add to the first version, unless a separate license comes with the update, in which case that license governs the update.
- 2.3 You may not share the Licensed Application or make it available to third parties (except as the Usage Rules allow), or sell, rent, lend, lease or otherwise redistribute it.
- 2.4 You may not reverse engineer, translate, disassemble, decompile, remove, modify, combine, create derivative works from, adapt, or try to derive the source code of the Licensed Application or any part of it, except to the extent the law allows this despite this clause.
- 2.5 You may not copy or alter the Licensed Application, except as this license and the Usage Rules permit. You may not remove any intellectual property notice. If you sell your device, delete the Licensed Application first.
- 2.6 Breaking these obligations, or trying to, can lead to claims for damages.
- 2.7 The Licensor may change these license terms for the future. A change applies to you from the next update you install or the next time you use the Licensed Application after we have announced it in the app or on this website, and does not reduce rights you have by law.
- 2.8 You must also comply with applicable third-party terms, for example Apple's, when using the Licensed Application.
3. Technical requirements
- 3.1 The Licensed Application needs an iPhone with iOS 26 or later, a working camera and Screen Time (Family Controls) permission from you for the lock features.
- 3.2 The Licensor tries to keep the Licensed Application working with new versions of iOS and new devices. You have no right to demand an update.
- 3.3 You are responsible for checking that your device meets these requirements. The Licensor may change them.
4. Maintenance and support
- 4.1 The Licensor alone is responsible for any maintenance and support of the Licensed Application. You can reach the Licensor at the address in section 10, and on the support page.
- 4.2 The Licensor and you acknowledge that Apple has no obligation whatsoever to provide any maintenance or support for the Licensed Application.
5. Use of data
The Licensor's use of your information is described in the Privacy Policy. You acknowledge that the Licensor may collect and use technical data about your device and the app, in the anonymous form described there, to provide support, deliver updates, and improve the Licensed Application, as long as it does not identify you.
6. Liability
- 6.1 Nothing in this agreement limits liability for intent, gross negligence, fraud, injury to life, body or health, or anything else that cannot be limited by law. Subject to that, the Licensor is liable for a breach of its duties only as the Terms of Use say (section 19 there).
- 6.2 To avoid losing data, keep your device backed up. The Licensed Application keeps your workout history on your phone only, and the Licensor has no copy.
- 6.3 The Licensed Application is a tool for physical activity and screen-time management and is not medical advice; see the health notes in the Terms of Use.
7. Warranty
- 7.1 The Licensor states that the Licensed Application is free of spyware, trojans, viruses and other malware when you download it, and that it works substantially as described in the app and on the App Store page.
- 7.2 There is no warranty for a Licensed Application that cannot run on your device, was changed without authorisation, was handled wrongly, was combined with unsuitable hardware or software, or does not work for other reasons outside the Licensor's control.
- 7.3 If you find a defect, tell the Licensor at the address in section 10 as soon as you can. This does not limit the time you have under the law.
- 7.4 If a defect is confirmed, the Licensor will fix it or provide a replacement version, and your statutory rights, for example to a price reduction or a refund, remain.
- 7.5 If the Licensed Application fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the Licensed Application, and any other claim, loss, liability, damage, cost or expense caused by a failure to conform to a warranty is the Licensor's responsibility.
- 7.6 This section does not limit the legal guarantees that consumers have in Israel, the EU or elsewhere.
8. Product claims
The Licensor and you acknowledge that the Licensor, and not Apple, is responsible for addressing any claim by you or a third party about the Licensed Application or your possession and use of it, including: (i) product liability claims; (ii) any claim that the Licensed Application fails to meet a legal or regulatory requirement; and (iii) claims under consumer protection, privacy or similar law.
9. Legal compliance
You state that you are not located in a country that is subject to a US Government embargo or that the US Government has designated a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
10. Contact information
For questions, complaints or claims about the Licensed Application, contact the Licensor: Karol Billik, billikkarol3@gmail.com, Borová 9, 951 01 Nitrianske Hrnčiarovce, Slovakia.
11. Termination
This license lasts until you or the Licensor end it. Your rights under it end automatically, without notice, if you fail to follow any of its terms; the Licensor will, where practicable, tell you why. You can end it at any time by deleting the Licensed Application (cancel any subscription separately in your Apple Account). When the license ends you must stop using the Licensed Application and delete all copies of it.
12. Third-party terms and beneficiary
The Licensor will comply with applicable third-party terms when using the Licensed Application, and you must too.
The Licensor and you acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this License Agreement, and that once you accept it, Apple will have the right (and will be deemed to have accepted the right) to enforce this License Agreement against you as a third-party beneficiary.
13. Intellectual property rights
The Licensor and you acknowledge that if a third party claims that the Licensed Application, or your possession and use of it, infringes that third party's intellectual property rights, the Licensor, and not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
14. Applicable law
This License Agreement is governed by the law of Slovakia, without its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory rules of the law of the country where you live (for example Israel or Sweden). The courts of Slovakia have non-exclusive jurisdiction, and a consumer may also sue and be sued in the courts of their country of residence, as in the Terms of Use.
15. Miscellaneous
- 15.1 If a term of this agreement is or becomes invalid, the rest stays valid. An invalid term is replaced by a valid one that achieves its main purpose as closely as possible.
- 15.2 Changes and additions to this agreement are valid only in writing, which includes a notice in the app or on this website.
